Help me remember exactly how this went. When Casey was declared indigent, Baez was told he should get expert witnesses in Florida (as well as the Mitigation Specialist). He said so much time had already been spent by all of these witnesses, that it would end up costing more to hire new ones. The mitigation specialist had developed such great rapport with ICA, etc. etc. Mitigation specialist is long gone, how many of the others that he fought for remain? And how many will be here at the bitter end? Karma is starting to kick up for sure. Caylee deserved so much more than this whole cast of characters, from her family to the ones trying to protect them. The jury will finish things up, the smirk will be gone, and we will always remember a sweet little girl that got the justice she was due.

HHJBP clearly stated an expert witness shall only be able to testify to what is written on their report. I would imagine if no report was given to the court pretrial..no testifying?

Baez has just requested "more time" to get reports turned over, yet now decides that he can tell the court that he's taking off an entire week.

Yup...if I'm understanding everything correctly that's what it means.

And that's what irks me to no end in this case. It's like that's exactly what JB wants. He doesn't want to actually take any experts off his list. He wants to screw up so bad with the pre-trial discovery process that Perry will finally say "enough, your experts can't testify" and then when casey gets convicted, JB can run around flapping his arms all over tv screaming about how she didn't get a fair trial and her experts weren't allowed to testify, etc. It's such garbage! Perry really needs to impose sanctions, and the sooner the better, IMO.

Yeah, his timing s*cks! I know that everyone is entitled to a vacation...and the courts are fair when it comes to notices of "unavailability"...but to put the two motions out there basically together is asking for trouble IMO. I betcha he is going to that conference. The agenda sounds really interesting...maybe Baez is going there to look for SOD (some other defense)...not to talk to those folks...cause for Pete's sake, he can always do that via a tele-conference.

I do not think that is what is happening here. I believe essentially what JB is doing is running through a pasture trying to avoid the "cow pies". There is no way to defend her, which is becoming more and more obvious to those who are following the case closely. JB is attempting to make it look as if his client is innocent, as he has publicly announced on many an occasion, and he has nothing, nothing to back up his theory. In truth, we may not like the truth, he is doing the best he can to put up a smoke screen. He has to walk that fine line because there is nothing to prove KC is innocent as he has claimed. KC has nothing to complain about because the evidence is there, circumstancial or not, it is what it is and JB can't make it go away.

I truly believe they are attempting to save her life but they know there is no way they will win this case against her. Right now it's about damage control. He knows they are already defeated. He's just trying to minimize the damage. jmo

I do soooo agree with the assessment of his dodging "cow pies" and he probably does know he's already defeated to win this case against her, but, in the process, he's making it more and more obvious that he has nothing. How does that equate to being effective? It doesn't. Even if he did, I don't think HE would know what to do with it.

If it's obvious to me, IMO, it's obvious to the legal world that he is incompetent to act as anyone's attorney in a case as serious as this one, thereby creating an open for KC to possibly gain access to either a mistrial or an automatic appeal based on his ineptness alone. Legal aspects of this are my biggest concern. JMO

I'd agree with this if I thought Baez was a competent attorney. But he's not. It's more like he's trying to save his career that he banked on a defendant he thought to be innocent, or at least thought he could prove innocent and make big bucks off of at the same time. Now he's up sh** creek without a paddle, and is doing everything he can to salvage what is left of his career, if anything is left. I think Ms. Boss won't give him the out he wants, and I think people are backing away like the defense is a plague at this point, and he's just left with little to nothing to work with. He should have done harder work sooner, not assume that these experts that AL got on board would have something to exonerate Casey. He's done nothing, and has nothing to show for it. I don't and never will feel sorry for him or think he's doing his job. He is a black smear on the law profession, an embarrassment. He is reaping now what he sowed by having dollar signs in his eyes instead of really defending a client that needs a defense.

Excellent post Aedrys.......my worry is his incompenty giving KC a crack in the door to slip through. She needs a "fair" trial, not a "circus". JMO

Looking back at the motion..I agree..that may change in the future if and when it does become necessary to call him as witness.
And if Dr Lee is still on the Defense Witness List he can always be called on.

Jose's way with words is most definitely deliberately misleading ... he likes to play word riddles and argue semantics ... pretty much saying nothing so it can't be held against him ...
His expert witness "list" is a good example ... he pretty much said that his experts may still be on the case or they may not be needed unless it's necessary to call them ... WTH? ...
Jose, we need a yes or a no, not maybe, not unless it's necessary, not if the planets align in a favorable orbit !!
Just like emailing and phone calls with the state ... deliberately evasive and informal ... he avoids filing discovery with the court at all costs ... and the maddening part is he still isn't being made to ...
