If the two arrested in different states and charged with "kidnapping" it would seem that her remains (body) was found with one of them,no?

IDK ... I thought the kidnapping charge would stem from the state she was taken from (Montana) no matter where the kidnappers ended up being arrested.

Also, I think the charges for murder (or similar charge) would stem from whatever state that occurred in; however, if it occured on tribal property, that's a whole other ballgame. JMO

I do not know for sure ... maybe we can get a legal expert to step in and give us info.

Considering it is taking this long for the agents to get all the info., these suspects sound like hardened criminals to me. They don't seem to be giving information away freely from a guilty conscience.

Interesting...I wonder who called in the tip?
One of the suspects? Or an eyewitness?
If it was an eyewitness it would be interesting to find out all that they saw/heard!

Well even if they are hardened criminals they should be scared chitless. Kidnapping charges have stiff penalties even when it is not over state lines.

And I hope they lean into these guys with all they have because if it was an accident for all we know Sherry might not have died if they would have taken her to the hospital. I don't know statistics, but people survive accidents like that.

The family is confirming Sherry's death but law enforcement is not, and is not saying anything about the body.

Montana defines aggravated kidnapping as "if a person knowingly or purposely and without lawful authority restrains another person by either secreting or holding the other person in a place of isolation.

The Bismarck Tribune's headline article title on Sat. Jan. 14 read "Law Enforcement Saying Little in Sherry Arnold Case," but credited the Sidney Mayor, Brett Smelser, as saying that,

"The news is not good, and as far as I know we don't have a body yet."

But on a Find Sherry Arnold Facebook page earlier this week, a comment was posted that her body had been found. And some news agencies have reported as much in the past few hours, like Keloland Television, which said,

"Her body was found Friday."

The Bismarck Tribune reported that Richland County Sheriff Frank DiFonzo, while sparse with his words on the investigation, did state that "As the result of a tip, we're able to announce that a significant breakthrough has been made [in the case]"

The breakthrough, according to DiFonzo, was the arrest Thursday night of a 47-year-old man in the disappearance of Arnold. Law enforcement officials also confirmed with the Sidney School District that Sherry Arnold was dead, prompting the district school superintendent Daniel Farr to confirm that "the notification came to the school at 9:30 a.m."

BILLINGS, Mont. — An eastern Montana woman reported a man tried to abduct her while she was stopped along the highway and made a threat that appeared to refer to a missing teacher who is now confirmed dead, Rosebud County officials said Friday.

Undersheriff Arlan Thingvold said the woman told officers she was stopped near a weigh station on a frontage road east of Forsyth Thursday afternoon when a man came up to her door, pulled out a fish fillet knife that looked like it had blood on it and said, "You need to come with me or you'll end up like that (woman) on TV," the woman reported.

The motorist, who lives in the area, believed he was referring to Sidney teacher Sherry Arnold, who was confirmed dead Friday. Arnold was reported missing on Jan. 7 when she didn't return from a morning jog.

The woman told officers she told the man to wait while she got her cigarettes, then reached down and pulled out a gun, Thingvold told The Billings Gazette (http://bit.ly/x1BY25 ). The woman said the man left without saying anything and drove off to the west in a 1980s faded red Chevrolet panel van.

The article was written a couple of days ago, so maybe that explains why it says they have only one man in custody.

I think its safe to say that they found Sherry and brought her home. So at least there's that.

I do think that many news sources made the assumption that if LE was telling the family Sherry was dead, they had found her body. I ive outside Helena, and our local paper reported they had ... but I will say that the IR is prone to misinformation. IMO

I'm still really confused about whether or not they found Sherry. Before her husband sounded like he was saying that they had, and now in this article he is saying maybe.

There is a lot more going on than just bad reporting.

Well.. Now I'm even more certain of ONLY ONE THING, period!!!.. And that only thing I'm certain of is that I'm awaiting a LE official to publicly make their statement of what, when,who, and how Sherry Arnold passed away before I can even have an opinion about what has occurred!?!!.. Why oh why does our news agencies take absolutely zero pride in their reporting to the masses?? It's all about who can be the first to scoop all the rest, regardless of whether information and details they are publicly reporting are even remotely accurate or true!!! That seems to be the lowest on their list of priorities!! :steam rolls outta ears: .. Seemingly only thing important is to have the newest detail of an unfolding case FIRST TO HIT be it in print, television/radio, or online.. As long as their news agency has "something" to type up and throw out here to the public FIRST
is all that matters IMO!! Who cares that there is a very real human being VICTIM at the heart of what they are reporting!! With a family, friends, and community that are in an extremely vulnerable state of shock, disbelief, pain and anguish.. IMO whoever made the crappy report that the school is who received the anonymous tip about the two males involved in Sherry's death and the call came into the school Friday, the 13th in the 9o'clock morning hour really should be ashamed!!
Obviously this cannot be accurate and true no matter how they attempt to "spin it" as true!! The family was notified prior to 9am that same morning and told Sherry was deceased and atleast 1 man was in custody, immediately followed by that same info being delivered via a phone call to the school.. Obviously it is not accurate about the time, the date, nor the context of report.. None can be accurate and true when we know that the family and school were relayed this info of Sherry's death with atleast 1 man in custody.. that makes it impossible that in that same 9o'clock morning hour of Friday that the school received an anonymous tip "MARKING THE BEGINNING" of leading to these two men which held and hold the answers about Sherry Arnold..

I have no opinion on the who, the how, the when, or the where until we have an official statement that even gives us the basic info necessary to even begin to theorize on what may have happened and why..

That news site should be ashamed and embarrassed IMO!

Wow. Waters does have a long rap sheet. But it's mostly drugs, theft, drunk driving and small time stuff. There's not much on there that would indicate "vicious killer."

I'm thinking we'll find out what happened soon. Poor Sherry -- just trying to get some exercise.
