Man charged in killing Westland teen found competent to stand trial

A man charged with murdering a Westland teenager has been found competent to stand trial.

At a hearing Friday morning, Wayne County Circuit Court Judge Ulysses Boykin accepted a psychologist's report that Justin Lee Yoshikawa, 19, is criminally responsible and competent to stand trial. Yoshikawa is charged with first-degree murder in the death of Carlee Morse, 16.

From the same article, trial set to begin in early July, and last for 6 days. The mother of the other man will go to trial on the same day, for attempting to silence a witness.
 
Justin Yoshikawa's trial has been delayed.
It was set to begin this week, but DNA evidence delay has pushed the trial back to October.

And Tina, Nicholas Cottrell's mother, has entered a guilty plea:
Meanwhile, Tina Marie Lowe, 49, has entered a guilty plea Monday to a charge of interfering with a police investigation and scheduled to be sentenced Aug. 8. Lowe is the mother of Nicholas Cottrell, who has already pleaded guilty to helping murder Morse. A charge of being an accessory after the fact was dropped as part of Lowe's plea.

On Tuesday, Aug. 8, Wayne County Circuit Judge Ulysses Boykin sentenced Tina Marie Lowe, 49, to two years probation and ordered her to pay $783 in fees and court costs. Lowe had been charged with accessory after the fact to a felony and interfering with a police investigation related to disappearance of the Westland teenager, but the accessory charge was dropped as part of a plea deal.

Cottrell pleaded guilty to second-degree murder and is serving 25-50 years in prison. He is currently housed at the Saginaw Correctional Facility with his earliest possible release date in 2035.

JY's trial is still on schedule for October. NC will be testifying for the prosecution s part of his plea deal.

Judges adjourns Morse murder trial

The trial of a Belleville man charged with murdering a Westland teenager has been delayed a second time at the request of prosecutors.

A jury trial had been scheduled to begin Monday in Wayne County Circuit Court for Justin Yoshikawa, 19, who is charged with first-degree murder in the death of Carlee Morse, 16.

Judge Ulysses Boykin agreed to adjourn the trial until Nov. 21 to allow more time for the Wayne County Prosecutor's Office to receive DNA test results.

After driving for about an hour, the two put Morse’s body in the trunk and went home and parked in a garage. The next night, Yoshikawa went into the garage alone and put Morse’s body into garbage bags, Cottrell said. Cottrell said it was after 11 p.m. when they drove south on a freeway for an hour or two looking for a spot to dump the body.

“He just wanted me to get rid of the body,” Cottrell said. “He wanted to throw it somewhere.” They ended up behind a red brick church. Cottrell said that because of drugs and shock he doesn’t have any recollection of where the church is. He said he remembers the words “Holy Ghost or Holy Spirit.”

I want to go back to the list of churches and see if any have Holy Ghost or Holy Spirit in the titles.

Cottrell said he believed Yoshikawa intended to kill Lori Morse, as well. “He told me that after the fact,” Cottrell said. He also said that Yoshikawa has killed other people. He said he didn’t previously tell police because he was afraid of Yoshikawa.

Yoshikawa told police during his confession that he killed other people, but that line of questioning was not pursued during testimony.

On the third day of his jury trial for murdering Westland teenager Carlee Morse, Justin Yoshikawa accepted a plea bargain that will send him to prison for 35 to 65 years.

Yoshikawa’s plea comes on the heels of Cottrell taking the stand and refusing to testify. Cottrell, 23, had also been charged with first-degree murder but was sentenced to 25- to 50-years in prison after pleading guilty to second-degree murder
[on the condition that he would testify in Yoshikawa's trial].

Cottrell refused to testify, stating that his guilty plea had been coerced.

Going against the advice of his defense attorney Solomon Radner, Cottrell refused to testify telling Boykin that his plea had been the result of coercion by Westland police. Cottrell told Boykin that he had lied when he had earlier testified the plea was coerced. Boykin is scheduled to hear arguments in Cottrell’s efforts to withdraw his guilty plea on Dec. 12.

For one, he had six months from his plea deal in early Feb. The six months long expired.
For another, Cottrell violated the terms of his plea, because he refused to testify for the prosecution in Yoshikawa's trial. The prosecutors read Cottrell's statement during Yoshikawa's trail, and then Y also took a plea deal.

Cottrell's sentence of 25-50 years stands. He may appeal the court's ruling on his appeal.

Yoshikawa is being sentenced today (Thursday, Dec. 15). He is expected to get 35-65 years. Carlee Morse's family will be able to make victim impact statements before his sentencing.

I wish the two would tell the family where they dumped Carlee's body.

16-year-old Carlee Morse was murdered by her ex-boyfriend and his roommate. More than a year later, her final resting place remains a mystery. Thursday, one of her killers received his sentence.
