No trial on Thursdays

No cameras in the courtroom during the Trial.

Not sure if reporters will be allowed phones inside the courtroom for live tweets. If not, we know the drill -- trial by Twitter during recess.

Potential jurors are not excluded/excused if they've heard of the case -- much deeper than that.

Screen protectors for everybody will be required as the courtroom is expected to be packed.

Defense wants potential jurors to be asked how they feel about a NGRI defense just like they are typically asked how they feel about the death penalty. Judge requests defense file a motion on this. Prosecutor suggests this can be part of the questionnaire. Judge is not averse to adding to the questionnaire but doesn't want an 18 pager -- it's a logistic issue for the court and scanning the document.

Judge cited Holmes, Frazzee, and Redwine, cases as why he's confident and has faith in selecting a jury for this difficult case.

Family members should plan on April 3 as the start date (ie., travel arrangements).

She tried to escape the van transporting her to jail. She tried to escape the jail itself. Now she’s trying to escape by pretending she’s insane; she isn’t. Those analyzing her better not be fooled.
 
IMPORTANT NOTE -- I believe the live stream for the Trial will be similar to the Redwine trial where the actual camera/audio is provided by the Court and NOT media cameras. The Court will allow media to broadcast/stream the court-provided service which complies with Colorado law. MOO

She has pleaded not guilty by reason of insanity in the case. During a court hearing Thursday afternoon, it was revealed that a report related to an additional mental health exam requested by her defense team has not yet been provided to the court. Stauch's attorneys said the exam was completed and said the report would be submitted by a Feb. 13 deadline.

Jury selection in the case is set to begin on March 20 and could take up to two weeks.

Judge Gregory Werner said he planned to bring in a pool of 110 jurors to narrow down to a panel of 12 plus six alternates. Evidence presentation is expected to begin no earlier than April 3.

Stauch is also accused of slipping out of handcuffs and attacking a deputy as she was transported to Colorado from South Carolina following her arrest, and plotting an escape from the El Paso County Jail. A separate criminal case is pending against her related to those incidents.
 

The jury trial process is expected to start on March 20 with an estimated 2 weeks of jury selection, an expected start of evidence presentation no later than April 3, and about 6 weeks for the presentation of the case.

Judge Greg Werner said two members of the press, one print and one electronic, will be allowed in the courtroom for jury selection only. Only audio recording will be allowed during this process. As of right now, no cameras will be allowed in the courtroom to cover the actual trial process.

Details on what will be on the jury questionnaires are yet to be finalized as the prosecution and defense will discuss how to include material on potential jurors' opinions on someone pleading not guilty by reason of insanity. Those issues should be resolved by February 16.

Judge Werner plans to issue a summons for 75 jurors a day until they have a qualified jury pool of 50 candidates to seat 12 jurors and 6 alternates for the case.
 
OMG- Is he giving his opening statement already by telling the judge he has to make a point to jury that jurors must be informed LS is not getting off if she is NGRI.

Fortunately, mental illness does not equal insanity. And I for one am not impressed with the defense's expert witness that hasn't been able to produce a written evaluation after months. :rolleyes:

I had a jury summons last April. So I guess I won’t be getting one for this. Bummer.

Yes, similar to the murder of minor Dylan Redwine, I think the judge is weighing how to preserve the integrity of the trial by providing media with the court feed for broadcast while answering the opposition by the defense. And for Colorado, I think this is fair consideration by the Court. JMO
